In March 2021, the Iraqi Parliament adopted the Yazidi [Female] Survivors’ Law (YSL) to provide reparations for survivors of ISIL crimes from the Yazidi, Shabak, Turkmen and Christian communities, with a particular focus on survivors of abduction and conflict-related sexual violence.
As part of the YSL application process, survivors have to file a criminal complaint in Iraq and provide investigative paperwork in their application. Today, more than 2,000 applications for reparations under the YSL have been approved. Yet, survivors who have resettled overseas face barriers returning to Iraq to obtain the investigative paperwork and apply to the law, preventing them from seeking reparations they are entitled to. A new pilot program initiated by the Iraqi General Directorate for Survivors’ Affairs (GDSA) seeks to overcome this obstacle; it will be tested in three European cities of Berlin, Frankfurt and Paris.
The GDSA, in cooperation with the Supreme Judicial Council and the Ministry of Foreign Affairs announced that survivors who live abroad and want to apply for reparations under the YSL will be allowed to file a criminal complaint and provide their testimony via video-conference in Iraqi diplomatic missions in Berlin, Frankfurt and Paris.
With this decision, survivors living abroad may be able to pursue the criminal investigation process, obtain the investigative paperwork and apply to the YSL via the online portal without being required to return to Iraq.
Warning - Survivors who are seeking or who have protected status (including refugee or asylum status, or other humanitarian protection) are advised to confirm whether requesting services from the Iraqi Embassy or Consulate will negatively impact their protected status or future claims. Survivors are encouraged to consult with a lawyer or NGO specialized in refugee, asylum, and immigration law.
Procedures to obtain an appointment to provide testimony through the Iraqi Consulate or Embassy:
The GDSA has advised survivors to provide information to the GDSA by WhatsApp at: +964 751 100 2977. Survivors should send the following information in order to schedule an appointment at their preferred diplomatic mission:
• Full name of the survivor
• Mother’s name
• Date of birth
• Current residence address
• Phone number
• Selected diplomatic mission for the application (Frankfurt, Berlin, or Paris)
Disclaimer: It is still unclear if the entire YSL application process can be done remotely or if survivors will still be required to complete some of the application processes in Iraq, for example if certain evidence cannot be obtained remotely, or if the Committee requests an in-person interview. Furthermore, it is unclear how providing testimony through video conferencing would apply to witnesses, particularly if they are outside Iraq and residing somewhere other than France or Germany.
